You would never know, if your exposure to judicial Orders were confined to Judge Cannon's, that judge's are partial to the adage, "You don't have to explain what you don't say". I mentioned "dicta" in the Motion to Dismiss Order. The last paragraph of that one began "Separately...", and then it went on to argue explain why she wasn't biased in her Order on the jury instructions, an issue that had nothing to do with the Motion to Dismiss, which I trust is patently obvious to laymen. Dicta is excess verbiage that cannot be cited as authority in subsequent cases. Cannon should have left that last paragraph out and should have left out, I'm estimating from having read it, maybe 50% of the seal Order, the subject of the preceding post.
When a judge engages in dicta he risks stepping on his dick, she risks getting her tit caught in a ringer, as it were, because where dicta is useful is in showing temperament and bias, and that is what Cannon showed in the seal Order. I'm tellin' ya, Jack Smith can build a mighty edifice in support of a motion to kick this dumb ass off this case.
