Chief Justice John Roberts has angrily ordered an investigation into the leak of the draft opinion striking down abortion as a constitutional right, while acknowledging that the draft was authentic. Such has never occurred in the modern history of the Court. Speculation, of course, immediately turned to who and why. I was convinced beyond a reasonable double that the leader had to be a clerk for one of the reasonable justices but an article in the New York Times today plausibly pointed out the motive for one of the reactionaries: to buck up any waverers and preserve the majority. On second thought, I didn't think that likely. Who would be this doubing Thomas. Clarence Thomas? Certainly not he. Kavanaugh? No. Barrett? No. Alito? He authored the majority opinion. Gorsuch? That is the most likely of the implausibles. I have gone back to my original opinion last night: the source was one of the reasonable justices' clerks.
