Trump Election Charges Set Up Clash of Lies Versus Free Speech
The indictment of former President Donald J. Trump over his efforts to retain power accuses him of conspiracies built on knowing falsehoods. His supporters say he is protected by the First Amendment.
Now, of course he’s not. The indictment SPECIFICALLY says he has the right to lie. It is not his speech, truthful or lies, that is criminalized, it is his CONDUCT. But this is EXACTLY what I warned about in the posts this morning: Why get into this mindless navel contemplation over lies when he could have been 100% truthful and the conduct still be criminal?
