In my view as a former state prosecutor and defense attorney Jack Smith has fucked up twice in two indictments.
1) In, and at the last minute, deciding to bring the MAL documents case in SDFL.
2) In the Jan. 6 case, in not charging Trump with, like, what makes Jan. 6 "Jan. 6", the violence.
According to Smith what we saw on Jan. 6 2021 was not violence but Defraud, Obstruction, something related to Rights. Smith has bowdlerized Jan. 6 into a legal tutorial on truth and lies and white collar crime, not wife beater street violence.
Smith has not given his admirers, me once among them, "The Big One." He has leveled the Matterhorn into gently rolling hills. There is no charge here on attempting to destroy democracy in America! None on overthrowing our government. None on thwarting the peaceful transfer of power. No sedition.
Trump, Smith has told us, is presumed innocent until, and if, proven guilty of the charges against him in a court of law. Since Smith didn't charge any violence, Trump is and will remain forever innocent of any violence on Jan. 6. And we must believe and declare his innocence.
