They don't have it. They don't have unlawful homicide cases against the cops and yet they charged them. These p.c. affidavits, when drawn by prosecutors, are their best case scenario. This is as good as it gets and it is not good enough. I am worried. I'm truly a little sick to my stomach I'm so concerned. No prosecutor I know or have ever known would file charges on that best case evidence. I worry for the legal profession. That probable cause affidavit is embarrassing to the profession. It's substantive inadquacy is most important of course and that shows a lack of competence and judgment but it is also poorly written and that is its own embarrassment. It is unintelligent and uneducated.
I feel sorry for Freddie Gray who should not be dead and for his family, loved ones and friends. I feel their loss deeply. Moreso tonight, I feel the betrayal of their pain that these arrests today will bring for this is not justice. They wanted justice and these arrests are not justice. They do not know that now, they believe. They will know it.
Most of all tonight I feel horribly, absolutely horribly, for the defendants. Of course I do not know if they are in fact guilty or not, of anything, but I do know, I do know that the prosecutor cannot lawfully prove them guilty on this best case evidence. A jury may convict them, and that is the greatest nightmare, but that conviction will not stand. It will be overturned. That is small comfort to the defendants tonight.
I worry too for the defense attorneys. When you know the prosecutor cannot lawfully convict your client but the prosecutor has had your client arrested! And now you must fight to get your client acquitted knowing that (s)he should never have been arrested--that is pressure.They are being railroaded. I am appalled. Sickened. Baltimore, Maryland has shown itself to be an Orwellian world this week, a city where wrong is right and right is wrong. Everything is upside down there. Stephanie Rawlings-Blake is not a good nor a competent mayor. Marilyn J. Mosby, the prosecutor, is incompetent, unintelligent, shows poor judgment or is corrupt, in the sense of bringing charges because of political pressure, or she is all of the foregoing. The citizens of Baltimore are racist thugs and I do not feel sorry for them.
